This California Privacy Notice (the “Notice”) sets forth the disclosure obligations of Locus Robotics, [Inc.], and its subsidiaries and affiliates (collectively, “Locus,” “we”, “us,” and “our”) under California law, including the California Consumer Privacy Act of 2018, [as amended by the California Privacy Rights Act of 2020 (“CPRA”)] (collectively, “CCPA”) and the California Civil Code section 1798.83, as amended.
This Notice provides the additional details regarding the information defined as ‘Personal Information’ under applicable California law and related to a California resident or household (“Consumers,” “User,” or “you”) referred to as “Personal Information.” This Notice describes the categories of Personal Information Locus has collected, the categories of Personal Information Locus has disclosed, the categories of Personal Information Locus has sold (if any), and a description of the Consumer’s rights. This Notice supplements the information contained in the Locus Robotics Privacy Policy.
We collect Personal Information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a Consumer or device. In addition to the Personal Information set forth below, please also consult our Locus Robotics Privacy Policy for a further description of the types and categories of information we collect.
Personal Information does not include (i) publicly available information that is lawfully made available to the general public by way of federal, state, or local government records; (ii) de-identified or aggregated consumer information; and (iii) information excluded from the CCPA’s scope, like: (a) health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data, and (b) Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Locus may disclose your Personal Information to a third party for a business purpose as described in the Locus Robotics Privacy Policy. In the preceding twelve (12) months, Locus has disclosed the following categories of consumer information for a business purpose:
The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights. Please note that these rights are not absolute and in certain cases are subject to conditions or limitations as specified in the CCPA or other laws.
You have the right to request that Locus disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. Once we receive and confirm your verifiable Consumer request (see Exercising Your Rights), we will disclose to you:
You have the right to request that the information described above be provided to you in a portable and readily useable format, to the extent technically feasible (“data portability”).
You have the right to request that Locus delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

To the extent that we may maintain inaccurate Personal Information, you have the right to request that we correct such inaccurate Personal Information taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information. Once we receive and verify your verifiable consumer request, we will use commercially reasonable efforts to correct your Personal Information.
You have the right to opt out of the processing of your Personal Information for the following purposes:
The use of online tracking technologies may be considered a “sale” or “sharing” under California law. To the extent that these online tracking technologies are deemed to be a “sale” or “sharing” under California law, you may opt out of these online tracking technologies by submitting a request or by broadcasting an opt-out preference signal, such as the Global Privacy Control (GPC).
You have the right to request that we limit the ways we use and disclose your Sensitive Personal Information (as defined by CCPA) to uses which are necessary for us to provide services, or deliver the goods reasonably expected by you, or and as authorized by law.
You have a right to the categories and names/addresses of third parties that have received Personal Information for their direct marketing purposes upon simple request, and free of charge.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. Depending on the request(s) submitted, you may need to:
Provide sufficient information that allows us to reasonably verify whether you are the person about whom we collected Personal Information or an authorized representative.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We may not be able to respond to your request if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Making a verifiable consumer request does not require you to create an account with us.
We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
You may use an authorized agent to submit verifiable consumer requests on your behalf provided that the authorized agent is a natural person or a business entity that you have authorized to act on your behalf. If you use an authorized agent, we will require: (i) proof of written permission for the authorized agent to make requests on your behalf, and identity verification from you; or (ii) proof of power of attorney pursuant to California Probate Code sections 4000 to 4665. We may deny a request from an authorized agent that does not submit proper verification proof.
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time by submitting a request to privacy@locusrobotics.com. Additionally, to the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits Users of our Websites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Locus reserves the right to amend this Notice at our discretion and at any time. When we make changes to this Notice, we will post the updated notice on the Websites and update the Notice’s effective date.
